One of the key debates in federal endangered species protection is whether such protections are actually "interstate" and properly regulated under the Commerce Clause. Each population of the pupfish species complex is quite local in their habitat, but the suite of the species/sub-species exists across states and even international borders, and there is evidence of occasional gene flow between the different populations. So interesting . . . for a nerdy person like me :)"<br /><br />Just to clarify -- the Commerce Clause is the clause in the US Constitution that gives Congress the power to regulate interstate commerce. That's the constitutional hook for federal environmental protection statutes; so if it turns out that such protection doesn't constitute "interstate commerce" those statutes would be unconstitutional and the protection of the pupfish would depend on the individual states' taking action. <br /><br />(I knew I'd read at least one of those pupfish cases in law school, but I'd forgotten the bit about the Commerce Clause, which probably was a good thing for Lady and Dad, since you can be sure I'd have given them all sorts of unwanted legal details instead of just letting them enjoy the little fish...)JJDhttps://www.blogger.com/profile/11153414049426124483noreply@blogger.comtag:blogger.com,1999:blog-6668337810746103818.post-64160516007075273582012-11-25T10:59:26.425-05:002012-11-25T10:59:26.425-05:00It was a fun, very interesting day trip.
